While granting bail, the Supreme Court stated that since the chargesheet has been filed and the trial is unlikely to conclude soon, there is no justification to keep Kejriwal in jail for an extended period. He will be required to furnish a bail bond of Rs 10 lakh.

The court noted three key questions based on the arguments: whether the arrest was illegal, whether the appellant should be granted regular bail, and whether filing the chargesheet alters the circumstances enough to send the matter to trial. The bench found no irregularity in the arrest, as the CBI had provided valid reasons for taking this action. The court stated that there was no violation of Section 41A(iii). Regarding the arrest, Justice Surya Kant remarked that Kejriwal’s arrest was not illegal.
The Supreme Court also directed Kejriwal to refrain from making any public comments on the merits of the case. The conditions imposed in the ED case will also apply here, and Kejriwal must fully cooperate with the trial court.
